SURVIVAL OF TERMS:

These terms shall remain in effect for as long as you use the Services. Either you or World Pass Connect Pvt. Ltd. may terminate access to the Services at any time, with or without cause and without prior notice. Any provisions that by their nature should survive termination, including but not limited to indemnification, limitation of liability, and disclaimer of warranties, shall continue to remain in full force and effect following such termination.

DISCLAIMER OF WARRANTIES

YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WORLD PASS CONNECT PVT. LTD. RESERVES THE RIGHT TO MODIFY, SUSPEND, OR DISCONTINUE ANY FEATURE OR FUNCTIONALITY OF THE SERVICES AT ANY TIME, AT ITS SOLE DISCRETION AND WITHOUT PRIOR NOTICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WORLD PASS CONNECT PVT. LTD. DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WORLD PASS CONNECT PVT. LTD. DOES NOT WARRANT THAT:

  • * THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS;
  • * THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
  • * THE RESULTS OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE, RELIABLE, OR COMPLETE; OR
  • * ANY DEFECTS OR ERRORS IN THE SERVICES WILL BE CORRECTED.

YOU UNDERSTAND AND AGREE THAT ANY MATERIAL, DATA, OR CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICES IS ACCESSED AT YOUR OWN DISCRETION AND RISK. YOU SHALL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM, MOBILE DEVICE, NETWORK, OR LOSS OF DATA RESULTING FROM THE USE OF SUCH MATERIALS.

WORLD PASS CONNECT PVT. LTD. MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING ANY PRODUCTS, GOODS, OR SERVICES PURCHASED OR OBTAINED THROUGH THE SERVICES OR ANY TRANSACTIONS ENTERED INTO THROUGH THE SERVICES.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM WORLD PASS CONNECT PVT. LTD. OR THROUGH THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

LIMITATION OF LIABILITY:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORLD PASS CONNECT PVT. LTD., ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, BUSINESS INTERRUPTION, OR COMMUNICATION FAILURE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOU AGREE THAT YOUR SOLE AND EXCLUSIVE REMEDY UNDER THESE TERMS SHALL BE THE DISCONTINUATION OR CANCELLATION OF THE SERVICES.

PAYMENT AUTHORIZATION DISCLAIMER:

World Pass Connect Pvt. Ltd. shall not be liable for any loss or damage arising directly or indirectly from the decline of authorization for any transaction due to the cardholder exceeding any preset spending limit or transaction limit established between the cardholder and the acquiring bank, issuing bank, payment gateway, or any other financial institution involved in processing the transaction.
